Donor Certified LPA

Attorneys will need to obtain an LPA to many different parties so it is always a good idea to have a certified copy on you when this happens. This is also beneficial because it means that you don’t need to wait for a certified copy to come in the post and it also means that you can show multiple parties at any one time. A lot of solicitors will charge you a hefty amount for this and in some instances, they may even refuse to do this if they haven’t created the LPA themselves.

Donors should be aware however that legally they had the mental capacity needed to create their own registered LPA. This can be confirmed by contacting the Office of the Public Guardian. They will have the information in the letter that is often given with the LPA itself.

If you do find that you need to make more copies of an LPA then this is possible, you just need to make sure that you take a photo of the original LPA before signing the date on each and every page. You will also need to state, in writing, that the contents are true and that every page in the document has been approved by the lasting power of a qualified attorney. On the very last page, you will need to write again that this is true, but if you feel unsure about this or if you don’t want to make a copy by yourself, you can always ask your solicitor to do it for you. They will make sure that it is all certified but they will most likely charge a fee for it as well.
